Terms & Conditions

1. About Thinkimation. Thinkimation builds and delivers digital products — including websites, applications, and related services — for businesses.

2. Engagement. By submitting an onboarding request or engaging our services, you agree to work with us in good faith to define project requirements, provide necessary content/information, and complete payments as agreed.

3. Electronic Consent. Agreements and confirmations with Thinkimation may be executed electronically in accordance with the Information Technology Act, 2000. By replying "I Agree" (or any clear affirmation) via WhatsApp, email, or other digital communication channels, and/or by proceeding with payment, you provide absolute acceptance of the applicable terms. Such digital actions are deemed equivalent to a physical handwritten signature.

4. No Setup Fee. Thinkimation does not charge a one-time setup fee for website creation. Your website is built and delivered as part of your ongoing subscription, described below.

5. Subscription & Autopay. Paid access to your website is provided on a monthly or yearly subscription basis, billed automatically ("autopay") through our secure payment partner, using the payment method you authorize at checkout. By authorizing a subscription, you consent to recurring charges at the frequency and amount shown at checkout until the subscription is cancelled. Failure to complete a scheduled payment may result in your website being made temporarily inaccessible to visitors until payment is resolved.

6. Visitor Limits. Each subscription tier includes a monthly visitor allowance as stated on our pricing page (for example, "up to 12,000 visitors/month"). A "visitor" is counted once per browsing session on your website, regardless of how many pages or properties that visitor views during that session — viewing multiple pages or properties in a single visit does not count as multiple visitors. Should your website's visitor count approach or exceed your plan's monthly allowance, we will notify you in advance where reasonably possible, and your website may become temporarily inaccessible to further visitors until you upgrade your plan or your next billing cycle begins, whichever comes first. Visitor counts reset at the start of each billing cycle.

7. Price Changes. Thinkimation may revise subscription pricing for new billing cycles. Existing subscribers will be notified in advance of any price change affecting their plan. Continuing your subscription after a price change takes effect means you accept the new pricing for subsequent billing cycles.

8. Upgrades & Downgrades. You may request or self-initiate a change to a higher or lower subscription tier at any time through your account. Upgrades may involve an immediate prorated charge and take effect immediately. Downgrades take effect at the end of your current billing cycle, with no charge collected at the time of the downgrade request. Thinkimation is not responsible for service limitations experienced under a lower tier after a downgrade takes effect.

9. Cancellation & Refunds. You may cancel your subscription at any time through your account or by contacting us. Upon cancellation, you will retain access to your website until the end of the billing period you have already paid for; no partial refunds are issued for unused time within a billing period. Amounts already charged for a billing cycle are non-refundable once that cycle has begun, except where required by law.

10. Project Delivery. Timelines are estimates and may vary based on project complexity, client responsiveness, and revisions requested. We will communicate any significant delays.

11. Client Responsibilities. You are responsible for providing accurate business information, content, and timely feedback needed to complete your project.

12. Ownership. Your website and its content remain accessible for as long as your subscription is active. Thinkimation retains ownership of the underlying platform, codebase, and template used to build and operate your website, excluding your own business content (such as property listings, photos, and branding) which remains yours.

13. Limitation of Liability. Our services are provided on an "as-is" basis. Thinkimation is not liable for indirect, incidental, or consequential damages arising from the use of delivered products or services, including any loss of business resulting from service interruption due to payment failure or subscription cancellation.

14. Termination. Thinkimation reserves the right to suspend or terminate access to your website for non-payment, misuse of the service, or violation of these terms, with or without prior notice depending on the severity of the issue.

15. Changes to These Terms. We may update these terms from time to time. Continued engagement after changes means you accept the updated terms.
